Important Update – Rule 11 (Loan and Security Documents) of the Legal Profession Uniform Legal Practice (Solicitors) Rules 2015 


This rule, inter alia, governs what is required when solicitors are giving what have been known as Practitioner Guarantee Certificates or Independent Solicitor’s Certificates.

The rule requires that solicitors holding a practising certificate in NSW must use the specified forms published by the Law Society of New South Wales and those holding a practising certificate in Victoria must use the specified forms published by the Law Institute of Victoria. The rule does not make any express reference to solicitors holding practising certificates in WA (WA solicitors), or the forms that they may be required to use.


Further to our notice on the above in our newsletter of 5 April 2023, the Law Society and the Legal Practice Board have liaised with the Law Society of New South Wales to amend its forms to make them suitable for use by WA solicitors. The forms have now been updated and can be found on the website's Legal Profession Uniform Law Hub here.
